WSBA Bylaw 167: Misconduct Panel

(Adopted March 2, 2011)

  1. Panel operating procedures.
    1. Upon a charge of misconduct or a suspension pursuant to Bylaw 115 the panel shall notify the accused of the charge. All charges are strictly anonymous.
    2. The accused has three days to request a hearing, which includes the day in which such accused is notified of the charge. If the accused requests a hearing, a hearing before the panel should be arranged within two weeks of his or her request. Such hearings shall be open to the public.
    3. If the accused does not request a hearing, the panel will accept the violation as true and will confer and act as it finds necessary and appropriate.
    4. The panel will act by a simple majority vote. The decision of the panel is final and only subject to review by three-fourths of the Executive Council Members.
    5. Record Keeping; Panel Voting.
      1. Records. The panel is required to maintain detailed minutes from any hearing conducted, whether the accused has chosen to attend or has waived his or her presence.
      2. Voting. Each panel member is required to vote.
        1. Upon a charge of misconduct, the panel may only vote to remove the officer or to take no action on the charge.
        2. Upon a suspension, the panel may only vote to remove the officer or reinstate the officer.
      3. The vote of each member is to be recorded in the minutes and should include the name of the member and how they voted. Should the matter be reviewed by the Executive Council, the same reporting requirements apply.
  2. Panel Authority. The panel’s authority to sanction an officer under this bylaw is strictly limited to the following sanctions:
    1. Removal of an Executive Council Member from office.
    2. Reporting honor code violations, if applicable, to the administration. It shall be the duty of the panel to report any potential honor code violations.
  3. Misconduct is defined and the composition of the Misconduct Panel are set out in Article VIII, § 2 of the WSBA Constitution.
